Right of withdrawal

1. Who this instruction applies to

The following instruction is addressed only to consumers within the meaning of § 13 of the German Civil Code (BGB) — a natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business, or profession.

If you contract with Horváth Digital Solutions™ as an entrepreneur (§ 14 BGB) or otherwise not as a consumer, you have no statutory right of withdrawal for these Services. Contract duration (term of the Services) and termination follow the Terms and Conditions.

Contracts for these Services are distance contracts for services, not a supply of digital content on a tangible medium with a special expiry of the right of withdrawal. Provider identity and statutory contacts are in the legal notice. This instruction is provided in German and English. In case of conflict or ambiguity, the German text is authoritative. The English text is a convenience translation.

2. Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day of the conclusion of the contract.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

3. How to exercise the right

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unambiguous statement (for example a letter sent by post, fax, or email, or a declaration in the customer portal). You may use the model withdrawal form in §5, but it is not obligatory.

4. Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract. HDS does not delay provisioning of Services solely because a consumer withdrawal period is running.

Complete and return this form only if you wish to withdraw from the contract. Completing it is optional; any other unambiguous statement is sufficient.
